Acceptable Use Policy

1. Purpose and scope

This Acceptable Use Policy ("AUP") governs how you may use the PermitMiner platform, its data outputs, and any features made available through your subscription, including the outreach email automation feature. This AUP is incorporated by reference into the PermitMiner Terms of Service. Capitalized terms used but not defined here have the meanings given in the Terms of Service.

By using the Service, you agree to comply with this AUP. Violation of this AUP may result in suspension or termination of your account as described in Section 5 below.

2. Prohibited conduct

You may not use the Service to:

2a. Unlawful use

  • Violate any applicable federal, state, or local law, regulation, or ordinance, including laws governing commercial solicitation, data use, privacy, and electronic communications.
  • Use the Service or any data obtained through it for any purpose that is illegal, fraudulent, deceptive, or harmful.
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity in any communication facilitated by the Service.

2b. Prohibited outreach and communications

  • Send any commercial email that violates the CAN-SPAM Act, including emails that lack a valid physical postal address, a clear and conspicuous opt-out mechanism, or accurate header information.
  • Fail to honor any opt-out or unsubscribe request within the timeframe required by applicable law.
  • Send unsolicited bulk email (spam), unsolicited text messages, or any other unsolicited commercial communications in violation of applicable law.
  • Use the Service or contact data in connection with telephone solicitations that violate the TCPA or applicable state do-not-call laws.
  • Contact individuals or businesses on applicable do-not-call, do-not-contact, or suppression lists.
  • Send harassing, threatening, abusive, defamatory, obscene, or otherwise objectionable communications to any person.
  • Use contact data for any purpose other than legitimate B2B solicitation for construction-related subcontracting opportunities. Using contact data for consumer marketing, recruitment, insurance solicitation, financial services solicitation, or any other unrelated purpose is prohibited.

2c. Data misuse and redistribution

  • Resell, sublicense, redistribute, or otherwise transfer any data, reports, or outputs obtained through the Service to any third party, whether for compensation or otherwise.
  • Use any data obtained through the Service to build, train, or contribute to a competing product, service, database, or data compilation intended for resale or redistribution.
  • Use any data obtained through the Service to make eligibility, creditworthiness, insurance, employment, or other decisions about individual persons in a manner regulated by the Fair Credit Reporting Act (FCRA) or similar laws. The data is not a consumer report and is not intended for such purposes.
  • Share your account credentials with other individuals or allow others to access the Service under your account. Each subscription is for one authorized user only.

2d. Technical abuse

  • Use any automated scraping tool, bot, crawler, spider, or script to extract data from the Service beyond the export features we provide, or to circumvent any rate limit, access control, or other technical restriction.
  • Attempt to gain unauthorized access to any part of the Service, any other user's account, or any system or network used to deliver the Service.
  • Interfere with or disrupt the integrity or performance of the Service or any related systems, including by transmitting malware, viruses, or other harmful code.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or internal workings of any part of the Service.
  • Circumvent, disable, or interfere with any security feature, authentication mechanism, or access control in the Service.

2e. Intellectual property

  • Infringe the intellectual property rights of PermitMiner or any third party, including through unauthorized copying, reproduction, modification, or distribution of any part of the Service.
  • Use the PermitMiner name, logo, or trademarks in any manner without our prior written consent.

3. Your responsibility for outreach compliance

You are solely responsible for ensuring that every outreach communication you send using contact data from the Service, or facilitated by the outreach automation feature, complies with all applicable laws. This includes:

  • Maintaining and honoring your own suppression and unsubscribe lists as required by law.
  • Including all legally required disclosures in commercial email, including a physical postal address and a working opt-out mechanism.
  • Verifying that any contact information you use has not been subject to a do-not-contact request before sending a message.
  • Ensuring the content of your communications is truthful, non-deceptive, and consistent with applicable law.

PermitMiner provides tools and data; it is not a co-sender of your communications and bears no liability for them. Complaints, regulatory actions, or claims arising from your outreach are your sole responsibility.

4. Legitimate use of data

The data available through the Service is intended solely for legitimate B2B business development in the construction industry, specifically to help subcontractors and related businesses identify general contractors and project stakeholders on active permitted projects and make initial bid solicitations. You agree to use the data only for this purpose.

The contact information in our database relates to business contacts in their professional capacity. You agree not to use this information to contact any individual in their personal capacity, for personal solicitations, or for any purpose that would be inappropriate for professional B2B communication.

5. Enforcement and consequences

PermitMiner reserves the right to investigate suspected violations of this AUP. If we determine, in our sole discretion, that you have violated this AUP or that your use of the Service poses a legal, reputational, or operational risk to PermitMiner or to third parties, we may take any of the following actions without advance notice and without liability to you:

  • Immediately suspend or terminate your access to the Service.
  • Terminate your subscription without refund of any unused subscription fees.
  • Disable or restrict specific features of the Service, including the outreach automation feature.
  • Report suspected unlawful conduct to appropriate law enforcement or regulatory authorities.
  • Seek injunctive relief or other legal remedies to prevent or remedy a violation.

Termination for violation of this AUP does not entitle you to any refund of subscription fees paid.

6. Reporting violations

If you become aware of any use of the Service that violates this AUP, or if you have received communications from a PermitMiner subscriber that you believe are unlawful or abusive, please report it to us at:

Please include as much detail as possible, including the nature of the violation, the date and content of any communication received, and any identifying information about the communication. We take all reports seriously and will investigate promptly.

7. Changes to this policy

We may update this AUP from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by email or in-app notice. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated policy.
